Abstract

In this article the process of creation of the ombudsman institutes in post-Soviet
countries - members of the Council of Europe, is presented. The Council of Europe
has defined some rules, which should guide the creation and the functioning of the
ombudsman’s institute, paying particular attention to its apolitical and neutral
makeup. Consolidation of new democratic institutes in countries at an initial stage
of democracy development has appeared to be a difficult task. Still, in spite of the
problems of legal and organizational nature that get in the way of effective functioning
of the ombudsman’s institute in post-Soviet states, even during the shot period
of time of its existence it became one of the most effective tools of human rights
protection.
