The role of constitutional courts in the implementation of EU law in the national legal orders: the case of the new member states

Abstract

Basing on the analysis of constitutional courts judgments, the article defines the role of constitutional courts of new EU member states in the implementation of EU law into the national legislature. The article also deals with the research into peculiarities and specifics of EU law functioning in national legislatures as well as avoidance of collisions taking place as a result of such interaction. Due to the analysis of constitutional courts judgments, possible cases of compatibility control between EU legislature and fundamental national laws are outlined.
