NEW CODE OF JUDICIAL ETHICS: HARMONIZATION WITH THE INTERNATIONAL STANDARS

Abstract

Abstract. The process of reformation the judiciary in Ukraine is actively carrying out nowadays.
The legal status of judges is increasingly attracting the attention of the international organizations.
It is proved by the documents and recommendations adopted in the proper sphere.
A lot of steps were made in order to adapt the national legislation in accordance with the international
standards. Thus, «The concept on the improvement of justice to ensure the fair trial in
Ukraine in accordance with the European standards» was approved by the decree of the Ukrainian
President adopted on May 10, 2006 number 361/2006. The Law of Ukraine «On the judicial
system and the status of judges» № 2453-VI was adopted on July 7, 2010. It was prepared
with the assistance of international experts. The Council of Judges of Ukraine was obliged to
bring the Code of Professional Ethics for Judges in accordance with the provisions of the Law
of Ukraine «On the Judicial System and Status of Judges» by the decision of The Ukrainian
Congress of Judges adopted on September 16, 2010. It is another considerable contribution in
this way. That’s why the new Code of the Professional Ethics for Judges must correspond to the
current Ukrainian legislation and the international standards aimed to strengthening the independence
of the judiciary and strengthening its credibility in the society taking to account the
active processes of the European integration in Ukraine.
