The european mechanisms of protection the right to health: implementation features

Abstract

The article is devoted to research of the activities of the institution of the European Union and the Council of Europe in the field of protection of the right to health and defined the procedures of the implementation of the European mechanisms of the protection of this right. In addition, it is described the procedure of submittal of the claim on violations of the right to health and reporting on the respect of this right to the institutions of the European Union and the Council of Europe. The author focuses on the problem of protection of the right to health in the Member States, including Ukraine, in the light of the decision of the European Court of Human Rights. It is considered the results of the implementation in Ukraine of the European mechanisms of protection of the right to health and defined the measures to improve the practical application of the mechanisms of the protection.
