Abstract

In Roman law principle acted «Qui jure suo utitur, nemini facit injuriam», this translates as: «Who is exercising its right, which does not infringe upon the rights of others». However, while making the reservation: «Summum ius - summa injuzia», that means – «The completion of the law is the supreme injustice». It was understood that the right, brought in its formal sense of the absurd, ceased to be right, since it contradicts the goal of origin as a regulator of relations. In terms of building a democratic and social state of law is the main task of approving and ensuring human rights and freedoms. However, in practice, have to deal with the frequent occurrence of a person's own subjective rights and interests not only contrary to the interests of another person, but also with the purpose of causing harm. This is to prevent violations of the rights of other persons in the exercise of their personal rights, it is
necessary to establish criteria for determining the boundaries of the face of their subjective civil rights.
