Стаття присвячена застосуванню Європейським судом з прав людини права на життя у ситуаціях збройних конфліктів у контексті питання про співвідношення міжнародного права захисту прав людини і міжнародного гуманітарного права. Автор розглядає можливості звернення Європейського суду з прав людини до міжнародного гуманітарного права, та аналізує рішення Суду у т.зв. «чеченських справах».
The article deals with the application by the European Court of Human Rights of the right to life during armed conflicts within the context of the interrelations of the international human rights law and international humanitarian law. The author reviews possible ways and means of the application of international humanitarian law by the European Court of Human Rights and analyses the Court’s decisions in the so-called ‘Chechen cases’.
